Terms & Conditions
Preamble
Herewith contained are the terms and conditions under which Tribal Marketing (previously known as Point Marketing) hereinafter refered to as "the Agency" operate under.
Development Process
Development process: Some changes and alterations are made through a process of consultation with the client before development and design on the site commences. The following terms apply to Packages quoted for; a) Three minor changes may be made without additional charges before the site is published. b) Artwork, photos and copy to be supplied by the client unless otherwise specified.
The Standard Hourly Rate will apply for any work done outside a quoted package, including, but is not limited to, Additional Changes, Alteration or Updates. a) The current Standard Hourly Rate will be charged at R150 an hour for minor changes and R350 for major changes. b) The Standard Hourly Rate will be revised in February 2011.
Cross Browser Compatibility
All proposals, quotes and packages are priced to include layout and other compatibility among W3Chttp://www.w3.org/standards/about.html complaint browsers only. Should the client wish to include Cross-Browser Compatibility to Browsers that do not comply to W3C standards, this can be arranged at an additional cost per browser, per version.
Hosting:
a) Proposals, quotes, packages, competition prizes or advertising does not include hosting charges unless otherwise specified.
b) All hosting fees will be billed separately by your hosting company.
c) Any CMS (content management system) site requires at least one mysql database.
d) Should the Agency determine that the client’s current hosting company (ISP) pose obstacles in the development process, the Agency retains the right to change the hosting service (ISP.) This may lead to a period of up to 72 hours interruption in all hosting related services including email.
Payment Gateway:
a) Proposals, quotes, packages, competition prizes or advertising does not include Payment Gateway charges unless otherwise specified.
b) All payment gateway charges will be billed separately by your Payment Gateway Solution.
c) Any webshop, online store or eshop requires a payment gateway to process payments. Should the Agency determine that the client’s current Payment Gateway pose obstacles in the development process, the Agency retains the right to change the payment gateway service. This may lead to a period of up to 72 hours interruption in all web trading related services email.
Payment
Should payment not be received within the pre-aranged period, for what so ever reason, the Agency may set the website to an offline mode and suspend all related accounts.
Promotions and Competitions.
a) To enter any Competitions hosted by the Agency you will need to sign-up to the newsletter and ad your unique Promo-Code.
b) Duplicate Promo-codes will result in disqualification.
c) Winners will be published in the Monthly Newsletter.
d) Competition winners have 30 days to claim their prize.
e) Prizes are not transferable, nor can they be exchanged for cash.
f) Any website won must be advertising a product, service or cause with which the management of the Agency is willing to be associated.
g) there is only 1 winner per competition.
Referral Scheme
a) You must claim a referral, before a quote or proposal is submitted to the client, in writing via electronic mail (email.)
b) Should any disputes result in claiming a referral, the Agency may choose which claim to accept and its choice is final,
c) The credits earned is non-refundable,
d) Credits must be claimed within 6 calendar months from the date it was issued
e) Credit is issued only after final payment by the referred client.
f) the Agency may refuse any work at its own discretion
g) the conditions specified here, including the scheme in general, may change or be cancelled without prior notice.
